  1. Our Policy On Children.
    Children are not eligible to participate in the use of ChatCom.com services. We ask that minors (17 years of age and under) do not submit any personal information to us. If you are a minor between the age of 6 years and 12 years you can use our KidChatters chat service, but only in conjunction with your parents or legal guardians.   2. Kinds of Information We Collect From Our Users.
    The personally identifiable information we collect is used to enhance our services to our registered users. In our online registration form, we require certain personally identifiable information. The kind of personally identifiable information we collect for each registered user varies, depending upon what ChatCom.com services for which the user registers. Specific details regarding the kinds of personally identifiable information we collect for each category of registration follows:

    1. Guest User Registration:
      We require all users wishing to participate in ChatBobs Flea Market or to use certain guest chat services to complete our Guest User Registration Form. During this registration process we generate and collect certain personally identifiable information.

      The personally identifiable information collected about our Guest Users in completion of the Guest User Registration Form: User name (chat room and Flea Market "handle"), first name, last name, personal password. Email address and a secret word (used to confirm identity). If a user chooses to bid, buy or sell on our site, we collect information about the user's bidding, buying and selling behavior. We also collect other users' comments about buyer and seller users in our feedback area.

    2. Flea Market Seller Registration:
      We require all users wishing to offer to sell products and/or services in the ChatCom.com Flea Market to register as a Seller User and provide additional personally identifiable information.

      The additional personally identifiable information collected about our Seller Users in completion of the Sellers Registration Form: The verifiable personally identifiable information required includes the Seller User's first and last name, first and last name of the credit card owner, credit card billing address, credit card number, credit card expiration date, phone number and email address. The personally identifiable information we collect is not stored onto our server unless the credit card charge transaction is successfully completed.

    3. Regular User Registration:
      To become a Regular User at ChatCom.com, we require a one-time payment of a membership fee. We collect that fee through a secure  online  credit card transaction, processed by the Internet billing Company, Ltd. (IBill). The required credit card transaction helps us to ensure with reasonable certainty the true identity of the user and the fact that the user is an adult. 

      The personally identifiable information collected about our Regular Users in completion of the Regular User Registration Form: 
      The verifiable personally identifiable information required includes the Regular User's first and last name, first and last name of the credit card owner, credit card billing address, credit card number, credit card expiration date, phone number and email address. The personally identifiable information we collect during this transaction is not stored onto our server unless the credit card charge transaction is successfully completed.

      We use the professional services of a third party credit card processing company, the Internet Billing Company, Ltd. (IBill), to collect personally identifiable information during the credit card charge transaction process. Since we do not control how IBill handles the personally identifiable information provided to them during the credit card transaction, it is recommended that you click here to read the IBill Privacy Policy.

    For those registered users providing an email address from a free email service, we may require some additional information. We use this additional information to verify your name, address, and other information. We recommend that you not use the email address provided to you from a free email service.

    Once a user is registered, we use "cookie" technology to track certain personally identifiable information each time a registered child user attempts to log on to the Flea Market or a chat room. This information includes the URL and IP address that the user just came from, the registered User Name, and type and version of web browser being used. The information collected by "cookie" technology is used to make the Flea Market and chat room log on procedure easier and to authenticate the user for security purposes.

    "Cookies" are small pieces of information that are stored by a user's browser on the user's computer hard drive. Unless selected otherwise at login, the "cookies" we use are "session cookies," meaning that they are automatically deleted at the end of a session. 

    If you would like to disable the "cookie"  technology, you can usually do so one of two ways:

    • Most Web browsers automatically accept cookies, but you can usually change your browser to prevent that. You are always free to decline our "cookies" if your browser permits. Please check your browser's guidelines should you wish to prevent cookies.
    • If previously selected, deselect the option to "Remember My Information" on the log on page. You may have to reboot your computer after you deselect this option for the option to take effect and, in essence, erase the "cookie" information.

    If a registered user sends us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the site, we may collect such information into a file specific to you.

  3. How We Use the Information We Collect.
    We internally use personally identifiable information about our registered users  to improve our marketing and promotional efforts, to statistically analyze site usage, to improve our content and product offerings and to customize our site's content and layout. We believe these uses allow us to improve our site and better tailor it to meet our users' needs.

    We may also use personally identifiable information about registered users to deliver information to them that, in some cases, are targeted to their specific interests, such as targeted banners and promotions.

    We use a registered user's email address and, in rare situations mailing address or phone number, to contact a user regarding administrative notices from time to time.

    If a registered user chooses to conduct an auction or post a classified ad on our site or open a credit account, we use the user's address and billing information to bill the user and provide associated support.

    We use information in the file we maintain about a registered user, and other information we obtain from a registered user's current and past activities on the site, to resolve disputes, troubleshoot problems and enforce our ChatCom.com User Agreement. At times, we may look across multiple registered users to identify problems or resolve disputes, and in particular on rare occasions we may evaluate a registered user's information to look for registered users using multiple User Names or aliases.

  4. Disclosure of Your Information.
    We do not sell or rent any personally identifiable information about our registered users to any third party. We do aggregate personally identifiable information and disclose such information in aggregate to advertisers and for other marketing and promotional purposes. However, in these situations, we do not disclose to these entities any information that could be used to personally identify a registered user. Certain personally identifiable information, such as password, credit card number, and bank account number, are not disclosed in aggregate at all.

    Throughout the site, registered users are identified by User Name. The User Name can be used to identify a registered user's activities throughout the site. Other people can see a registered user's bids, feedback rating and associated comments, postings on the site, and so on. We also provide other registered users a number of ways to find out more about a particular user's site activities, such as the feature that allows registered users to quickly see all of the auctions being offered by a particular user at the time.

    In addition, other registered users will be given or can access additional personally identifiable information about you. Registered users may request your User Name, email address, phone number, city, state, zip code, country, and company information. Further, we automatically send an email to the winning bidder(s) containing the seller's User Name and email address, and we send an email to the seller containing the winning bidder's User Name and email address. All recipients of such information agree to restrictions on how they use and disclose such information, as described in Section #5 below.

    ChatCom.com cooperates with all law enforcement inquiries and with all third parties to enforce their intellectual property or other rights. We can (and you authorize us to) disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personally identifiable information or private communications will remain private.

  5. Acceptable Use of Other Users' Information.
    In order to facilitate interaction among all ChatCom.com members, our service allows you to access other users' email addresses and phone numbers. As a seller you will be sent via email the User Name and email address of the winning bidder(s), and as a winning bidder you will be sent via email the User Name and email address of the seller. By entering into our ChatCom.com User Agreement, you agree that, with respect to your use of other ChatCom.com user's personally identifiable information that you obtain through the site or through a ChatCom.com-related communication or transaction, you are not to use such information for delivery of any unsolicited commercial messages. In addition, under no circumstances, except as defined in this Section, can you disclose personally identifiable information about another user to any third party without our consent and the consent of such other user after adequate disclosure.

    ChatCom.com and our registered users do not tolerate spam. Therefore, without limiting the foregoing, you are not licensed to add a ChatCom.com registered user (even a user who has purchased an auction item from you) to your mail list (email or physical mail) without their express consent after adequate disclosure.

  6. Email to a Friend Service.
    The terms applicable to the Email to a Friend service apply to your use of that service. Without limiting the foregoing, you may not use the service to send spam.

    We do not use the email addresses you enter for any purpose other than to send your email. We do not rent or sell these email addresses, either. Indeed, we discard the email addresses after they have been used to send your email.

  7. Controling Your Password.
    You may not disclose your password to any third parties or share it with any third parties. If, despite the foregoing, you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.
  8. Changing Your Personal Information.
    Once you register, you will be able to review and change much of your personally identifiable information.

    ChatCom.com users always have the option of removing their contact information from our database if they decide they no longer wish to receive future communications or participate in any other part of our service. To do so, simply send email to:

    admin@ChatCom.com.

    Please remember that once posted, you cannot change or remove any public postings made in our chat rooms or other message areas or the feedback area.

    Upon your request, we will remove your credit card number and credit card expiration date from our databases. To make this request, email us at admin@ChatCom.com. However, if you have a free email service account, you may not request to remove your credit card from file unless you wish to terminate your account or place a different credit card on file. Such information will be removed after one billing cycle of your last sale at ChatCom.com unless your account is in dispute, in which case your information will be kept on file until the dispute is resolved.

    We will retain in our files information you have requested to remove in some circumstances, such as to resolve disputes, troubleshoot problems and enforce our User Agreement. Further, such prior information is never completely removed from our databases due to technical constraints and the fact that we back up our systems. Therefore, you should not expect that all of your personally identifiable information will be completely removed from our databases in response to your requests.

    You must promptly update your information if it changes.

  9. Third Party Disclosures by You.
    Our policy only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties, whether they are bidders, buyers or sellers on our system or other sites throughout the Internet, different rules may apply to their use or disclosure of the personal information you disclose to them. To the extent that we use third party advertisers, they adhere to their own privacy customs and policies. Since ChatCom.com does not control the privacy policies of third parties, you are subject to the privacy customs and policies of that third party. We encourage you to ask questions before you disclose your personal information to others.
  10. Our Security.
    ChatCom.com uses industry standard efforts to safeguard the confidentiality of your personal information. However, "perfect security" does not exist on the Internet.
